Please read these Terms of Service ("Terms", "ToS") carefully before using the Editta.app website and the AI-powered image editing services (the "Service") operated by the operators of the Editta.app website ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. User Accounts

  • Registration: When you create an account with us, you must provide information that is accurate, complete, and current. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

  • Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

3. User Content and Intellectual Property (IP)

A. Ownership

You retain all intellectual property rights and ownership of the images and content you upload, edit, or create using Editta ("User Content"). We do not claim ownership over your User Content.

B. License Grant

By uploading User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, and fully paid license to:

  1. Use, reproduce, and display the User Content solely for the purpose of providing, operating, and improving the Service (e.g., applying AI edits, generating previews, storing for later access).

  2. Make temporary copies of the User Content as necessary to execute the requested editing actions.

This license terminates when you delete your User Content from the Service.

C. Responsibility for User Content

You represent and warrant that:

  1. You own the User Content or have all necessary rights, licenses, and permissions to upload and use the content on the Service.

  2. Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

D. Prohibited Content

You agree not to upload, post, or transmit any User Content that:

  • Is unlawful, threatening, abusive, libelous, or defamatory.

  • Infringes upon any copyright, patent, trademark, trade secret, or other proprietary rights of any party.

  • Contains sexually explicit or pornographic materials, incites violence, or contains hate speech.

We reserve the right to remove any User Content that violates these provisions at any time without prior notice.

4. AI Functionality and Disclaimer

The Editta Service utilizes Artificial Intelligence (AI) for tasks such as background removal and advanced editing. You acknowledge and agree that:

  • Results are not guaranteed: The AI's processing results may not always be perfect, accurate, or meet your exact expectations.

  • No Warranty: We make no warranty regarding the quality or fitness for a particular purpose of the AI-generated output.

5. Fees and Payment

Certain features of the Service may require payment of fees. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms applicable to those features, as we may update them from time to time.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach the Terms, including, but not limited to, the Prohibited Content provision (Section 3D).

7. Limitation of Liability

In no event shall the operators of Editta.app, nor its staff or suppliers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

8. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction, e.g., the State of Delaware], without regard to its conflict of law provisions.
